These terms are an agreement between you and Gerardo Ruiz Dana ("we", "us"), the developer of On The One. They cover the On The One app for Mac (the "App") and the website at ontheoneapp.com (the "Site"). By buying, installing or using the App, or by using the Site, you agree to these terms. If you don't agree, don't use them.
1. Who can use On The One
You need to be at least 18 years old, or have permission from a parent or legal guardian who agrees to these terms for you. On The One is not directed to children under 13.
2. Buying the App
Purchases are processed by Lemon Squeezy, our reseller and merchant of record. When you buy, you buy from Lemon Squeezy, and Lemon Squeezy's Buyer Terms (https://lemonsqueezy.com/buyer-terms) apply to the payment, taxes and receipt. These terms apply to the App itself and to your license to use it.
Prices are shown in US dollars. Lemon Squeezy calculates and collects any sales tax that applies.
The App is a one-time purchase. There is no subscription and no account.
3. Your license
When you buy the App, we give you a personal, non-exclusive, non-transferable license to install and use the App on up to 3 Macs that you own or control, for your own practice and music making.
Your license covers every 1.x version of the App that we release. A future major version may be sold separately. If it is, the version you bought keeps working as it does today.
You may not:
- share, sell, rent or sublicense the App or your license key;
- copy the App except to install it on your own Macs as allowed above;
- reverse engineer, decompile or disassemble the App, except where the law allows it even with this restriction, and except as allowed by the open source licenses of the components listed at ontheoneapp.com/open-source;
- remove or change any notices in the App;
- use the App to build a competing product.
4. What you make is yours
Everything you play, record, arrange and export with the App is yours. That includes takes, Funk Lab projects, MIDI files and audio files.
The lessons, patterns, presets, sounds and other content that come with the App ("Built-in Content") are licensed to you, not sold. You may use Built-in Content in your own music, including music you release or sell. You may not redistribute Built-in Content on its own or as part of a pattern, loop, MIDI or sample pack or library.
5. Refunds
We offer a 30-day money-back guarantee. If the App isn't for you, email support@ontheoneapp.com within 30 days of your purchase with the email address you used to buy it, and we will refund you in full through Lemon Squeezy. No forms and no questions. After a refund, your license ends and you must stop using the App. See ontheoneapp.com/refunds.
6. Third-party services and content
Lessons, guided listening and Song Lab can play YouTube videos inside the App through YouTube's embedded player. The App uses YouTube API Services. By using the YouTube features in the App, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). The videos belong to their owners and are provided by YouTube. We don't host, own or control them.
Song titles, artist names and historical facts are used only to identify and describe music. On The One is not affiliated with or endorsed by any artist, label or rights holder.
The App can send MIDI to Ableton Live and other music software on your Mac. Some features, like the on-device coach, need Apple Intelligence and are only available on Macs and in regions where Apple offers it.
Apple, Mac, macOS and Apple Intelligence are trademarks of Apple Inc. Ableton and Ableton Live are trademarks of Ableton AG. YouTube is a trademark of Google LLC. On The One is not affiliated with or endorsed by these companies.
7. Open source
The App includes open source components. Their licenses, and where to get their source code, are listed at ontheoneapp.com/open-source and in the App. Nothing in these terms limits your rights under those licenses.
8. Updates and support
We may release updates that fix problems or add features. We aim to keep the App working on current versions of macOS, but we can't promise that every future version of macOS, every Mac or every MIDI device will be supported.
For help, email support@ontheoneapp.com.
9. Disclaimer
We work hard to make On The One useful and reliable. Still, to the extent the law allows, the App and the Site are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the App will be error free or that it will make you a better player by any specific date.
10. Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of the App or the Site. Our total liability for any claim related to the App or the Site is limited to the amount you paid for the App.
Some states don't allow some of these limits. If you live in one of them, some of these limits may not apply to you.
11. Ending the license
Your license lasts until it ends. It ends automatically if you get a refund or if you break these terms. When it ends, you must stop using the App and delete it from your Macs. Sections 4, 9, 10, 12 and 14 survive.
12. Governing law
These terms are governed by the laws of the State of Jalisco, Mexico, without regard to its conflict of law rules. Nothing in these terms takes away any right you have under the consumer protection laws of the state or country where you live.
13. Changes
We may update these terms. If we make a material change, we will update the date at the top and post the new version on the Site. The terms in effect when you bought the App keep applying to that purchase unless you agree to new ones.
14. Other terms
These terms, together with the Privacy Policy and the Refund Policy, are the whole agreement between you and us about the App and the Site. If a court finds part of these terms unenforceable, the rest stays in effect. You may not transfer these terms or your license to someone else. We may transfer them to whoever takes over On The One, and your rights under them stay the same. If we don't enforce a part of these terms right away, we can still enforce it later.
